EliteFTS® Mobile SMS Terms & Conditions

These Mobile SMS Terms & Conditions ("Mobile Terms") govern your enrollment and participation in EliteFTS.com Inc.’s ("EliteFTS," "we," "our," or "us") text-messaging program (the "SMS Program"). By opting in or otherwise agreeing to receive recurring automated promotional and personalized marketing text messages from EliteFTS, you agree to these Mobile Terms, our Privacy Policy, and Terms of Service. If you do not agree, do not participate.
Service Provider – SMS delivery is powered by Mailchimp (an Intuit Inc. company). Mailchimp transmits messages on our behalf via short code 82561 but does not use your mobile data for its own marketing purposes.
1 Program Description
With your express written consent, we may send:

Order-related alerts (e.g., confirmations, shipping updates, delivery notices);

Promotional messages (sales, coupon codes, product drops, restock notices, loyalty rewards);

Abandoned-cart reminders (sent after one hour of inactivity when items remain in your cart);

Event updates (giveaways, live streams, in-person seminars);

Customer-service notices (return authorisations, back-order status, policy changes).
How we identify abandoned carts: We use first-party cookies placed by our Shopify storefront to detect when a cart has been inactive for 60 minutes without purchase. At that point we may send a single reminder text. These cookies do not track you across other sites.
Message frequency varies by interaction but will not exceed eight (8) marketing messages per month unless you actively engage (e.g., reply YES) to trigger additional flows.
2 Opt-In Consent
You provide express written consent to receive SMS/MMS messages when you:

Check the SMS consent box during checkout or account registration; or
-
Text an opt-in keyword (e.g., START, ELITEFTS) to 82561; or
-
Submit your phone number in a pop-up or onsite form that clearly states you agree to receive recurring automated promotional and personalized marketing text messages.
Consent to receive SMS messages is not a condition of purchase.
3 Opt-Out & Help

To Opt Out: Reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any EliteFTS message. You will receive a single confirmation text and no further marketing messages unless you opt in again.

4 Message & Data Rates
Message and data rates may apply according to your wireless plan. You are solely responsible for any SMS charges imposed by your carrier.
Supported U.S. carriers include, but are not limited to: AT&T, Verizon, T-Mobile, Sprint, U.S. Cellular, and regional providers. The SMS Program may not be available on all carriers or in all areas. EliteFTS and carriers are not liable for delayed or undelivered messages.
5 Privacy & Data Use
We collect your phone number, message content, and related metadata solely to operate the SMS Program, prevent fraud, and comply with legal requirements, in accordance with our Privacy Policy. Mobile-opt-in data and consent will not be shared with third parties for their independent marketing purposes.
6 TCPA & CTIA Compliance

Express Written Consent: By opting in, you provide consent under the Telephone Consumer Protection Act ("TCPA") to receive autodialed or prerecorded marketing texts at the number you provided.

Disclosure: Messages may be sent via an automatic telephone-dialing system.

Opt-Out Compliance: You may revoke consent at any time by texting a recognized stop keyword.

CTIA Compliance: We adhere to CTIA Messaging Principles and Best Practices; abusive or unauthorised use is prohibited.
7 Eligibility & User Conduct
You must be at least 18 years old and a resident of the United States with a U.S. mobile number. You agree not to:

Sign up with someone else’s number;

Use the Program for unlawful or abusive purposes;

Interfere with the Program’s operation.
8 Termination or Modification
We may suspend or terminate the SMS Program
